Will learning disabled get equal access to critical care?

The charity Mencap is concerned about the latest NICE guidelines that have been put in place to deal with the extra demand for critical care due to coronavirus.


"These are unprecedented times and our NHS is under extreme pressure. But people with a learning disability and their families are deeply troubled that the latest NICE guidance for NHS intensive care doctors could result in patients with a learning disability not getting equal access to critical care and potentially dying avoidably."

"These guidelines suggest that those who can’t do everyday tasks like cooking, managing money and personal care independently – all things that people with a learning disability often need support with – might not get intensive care treatment. That’s why we urge NICE to include specific guidance on learning disability to make it clear that healthcare professionals should not judge patients on their cognitive ability when making life or death decisions. "

System detains young people inappropriately

"Evidence to the inquiry into the detention of young people with learning disabilities and/or autism was so `stark` and consistent that the Committee says it has `lost confidence that the system is doing what it says it is doing and the regulator's method of checking is not working. It has been left to the media, notably the BBC and Ian Birrell in the Mail on Sunday, to expose abuse. No-one thinks this is acceptable.` In relation to the Care Quality Commission, the Committee finds that `a regulator which gets it wrong is worse than no regulator at all`... "

"The Committee describes the `grim`, predictable pathway to inappropriate detention in these potentially `brutal` circumstances: Early family concerns raised with the GP or school lead to lengthy waits for assessment and diagnosis while the family struggles on alone, trying to cope. Then some trigger a home move, a parent falling ill unsettles the young person and their condition deteriorates. Professionals meet to discuss what should happen, but parents are not included. The child is taken away from their home and the familiarity and routine so essential to them, often many miles away and placed with strangers. Desperately concerned parents are treated as hostile and as a problem."

"Under these conditions, the young person unsurprisingly gets worse and is then put through physical restraint and solitary confinement - which the institution calls `seclusion`. As the child gets even worse so plans to return home are shelved. The days turn into weeks, then months and in some cases even years..."

Scottish childhoods: drugs, alcohol and beatings?

Or a simplistic view of adverse childhood experiences (ACEs)

"Across Scotland today one child in four is assessed as vulnerable when they arrive at primary school. Vulnerable means they lack confidence, social skills, emotional maturity, language capability and good physical health. They have poor wellbeing. Many have experienced serious trauma in the form of abuse (sexual, drugs, alcohol), violence and neglect. There are 15,400 Scots children currently in the care of social services."

"Across Scotland in 2017, £310 million was spent on 1,600 young people in residential care. In Glasgow, 93 children were placed in specialist residential care at an average cost of £228,000 a year. Most of these young people have complex needs and have lead traumatised lives. What does that say about us as a society and as adults?"

"The latest medical and scientific research into the lifelong consequences of poor parenting on the development of babies’ brains points to the fact that damage begins in the womb, where the foetus suffers trauma through experiencing external influences ranging from the mother’s drugs and alcohol use to beatings from violent men. This damage is exacerbated once born if the baby suffers a lack of the loving care that mothers across most species devote to their young..."

"The result is generations of young Scots who are incapable of recognising love when they find it, and cannot give it when it is required. They are damaged beyond repair in their first 1,000 days of life, from conception to two years old, and society bears the huge cost of coping with their lifelong struggles."

A more academic approach to adverse childhood experiences (ACEs)

"The notion of ACEs has become internationally mobile from its creation in the USA two decades ago...The concept of ACEs is gaining increasing traction in the UK and more widely as a means for policymakers and professionals in a range of services, especially health, social work and policing, to develop and use ‘tickbox’ protocols that generate individual ACE ‘scores’, and to make algorithmic-based decisions: about how to target resources and at whom, and when and how to intervene..." 

"In the UK, ACEs have found a foothold in relation to the Troubled Families Programme, with its focus on targeted, intense and time-limited intervention to ‘turn around’ families displaying dysfunction according to a set of social indicators, to address and prevent the ‘root causes’ of mental and physical disease and intergenerational social disadvantage in early childhood experience (Crossley, 2018)."

"Macvarish and Lee provide an analysis of the various perspectives on the advantages and limitations of an ACEs approach..., arguing that there are links into the wider ‘first three years movement’ which homes in on parents as both the cause and solution to childhood adversities and determining of future outcomes..."

"Mcvarish and Lee identify the way that ACEs discourse is heavily gendered, with mothers positioned as deterministic mediators for their children with little consideration of their own adversities. Davidson and Carlin consider class-based inequalities and values in resilience-informed youth policy and practice in the ‘ACE-aware’ nation of Scotland, to unpack the way that injustice is reframed as individual deficiency and young people in deprived areas are assessed and held to account against middle class social values. They call for policies that change circumstances rather than individuals."

The dangers of the HR5 Equality Act:

Fabricated illness on the increase


"Calls for a cross party inquiry into claims that a growing number of families are being accused of inventing or causing their children’s illness. It’s called Fabricated or Induced Illness (FII) and used to be known as Munchausen’s Syndrome By Proxy. It’s a rare form of abuse where parents exaggerate their child’s medical condition or even cause it."

"Campaigners and charities say many families have been wrongly accused and want the inquiry to look at what they describe as a `wave of false allegations` and the current guidelines around FII.
 5 Live Investigates first looked at this in March when we spoke to mums and dads threatened with having their children taken off them after being accused of FII. Following the programme, we have been contacted by other families who say this has happened to them. We’ve also been told about many other cases. One involves a mother accused of poisoning her two year old daughter and ordered to live apart from her for almost a year until the case was dismissed."

Inquest into death of teenager

"An inquest has opened into the death of a teenage boy at a children`s home on Hayling Island."

"Damian Szarch, 17, died on Wednesday, March 6 while at Poppy Lodge, in Church Road."

"Portsmouth Coroners` Court is preparing the inquest into the teenager`s death..."

"Speaking last week, a spokeswoman for Poppy Lodge said: `An active investigation is currently being conducted by Hampshire police and we are unable to comment at this time`..."

"Poppy Lodge is run by Hillcrest Children`s Services Ltd and provides care and accommodation for up to seven young men with complex difficulties."

"It is rated outstanding by Ofsted, who last inspected in September last year."

Inclusion in mainstream schools: another review

Only three years after the previous review of the education policy there are plans for another one.

A delaying tactic maybe ? To avoid providing much needed resources to schools?



"The proposal to integrate children with additional support needs (ASN) into primary and secondary schools, rather than educating them separately in special schools, has the support of the United Nations on the grounds it is the right of every child to be educated in their local community regardless of physical disabilities, learning difficulties or social, emotional or behavioural problems."

Education crises: is compulsory registration the answer ?

"The Children’s Commissioner for England has called for a compulsory home education register and strong measures to tackle ‘off-rolling’."

"In a report, Skipping school: invisible children, Anne Longfield also said there should be more support for families who home educate, a greater oversight of home schooled children and decisive action against unregistered schools..."

"Some children were completely out of sight of the authorities and ‘off the grid’ with research by the Association of Directors of Children’s Services (ADCS)/Dispatches showing 93% of councils say they are not aware of all the children in their area who are home educated. When local authorities offer to visit a home educating family, in 28% of cases the family refuses."

Of course, one of the reasons for an increase in home education is the failure of many mainstream schools to cope with children with additional support needs. [ASN]

Here is an example from Scotland:

"The presumption to mainstream sees all children taught in mainstream schools unless certain exemptions apply. Currently, more than a quarter of the pupil population in Scotland (28.7 per cent) has ASN, an increase of more than 68 per cent since 2012 (in part due to an increase in awareness and identification). This, however, is against the background of 500 fewer specialist ASN teachers and a reduction in support staff, such as education psychologists and behaviour support staff..."

"A lack of classroom support, driven in part by budgetary cuts, means that many of these vulnerable children and young people are not having their educational and social needs met. This is also putting pressure on fellow pupils and teachers, with many of the latter lacking the necessary training to provide the specialist support required."

"Figures show the total fell by 80 people in three years, from 2,395 in March 2015 to 2,315 in September this year, while the number of children has increased, from 110 in March 2015 to 230 in September."
"Latest figures show 60% of patients in ATUs have been admitted for more than two years and 16% for more than a decade."

"Figures released to Sky News under the Freedom of Information Act reveal that reported uses of restraint, categorised as including the use of medication, seclusion of patients, and physical restraint including face-down `prone restraint`, have soared in the last two years..."

Innocent young people imprisoned in institutions

"Imagine that it was your son, your daughter, your sister, your brother. Taken away by the state against their will to be locked in an institution hours from home. Forced to take drugs they do not need, turning them catatonic, unable to stop dribbling and if they resist, held down by six guards, stripped and injected with strong sedatives. Stuffed in a tiny cell with just a mattress on the floor, fed through a hatch like a wild animal. Sometimes with no shower, no sink, no toilet paper and always with no dignity."

"Your relative, of course, has rights as a citizen. Even if they carry out evil crimes, they are protected by rigorous laws. Yet such actions are being inflicted on innocent young people with autism and learning disabilities. They are being handcuffed, bruised, restrained face down by teams of adults, even having their spectacles removed. They must obey orders to access books, television, even fresh air. Some slump into depression and shed weight, others swell up through over-eating. Yet if families protest, they can be legally removed as protectors and publicly silenced with court orders that threaten to seize all assets." 

"These stories sound Dickensian. They remind us of pitiful footage from foreign orphanages or places where people with mental illness are chained to trees. Yet this is happening right here in our country. It is happening right now in secretive psychiatric institutions both private and state-owned. These practices are a flagrant denial of the most basic human rights for British citizens but they are permitted by politicians, sanctioned by doctors and funded at huge expense by taxpayers."

Indoctrination in schools

Brian Gerrish: "Well, change of subject and an introduction to David Scott, but let`s just have a look very briefly at this. Several people sent this into us. It`s a youtube video clip which shows a teacher at a primary school encouraging, teaching, showing very small children how to write letters to ask a man Thomas to marry them. And the significance of this is that the boys are writing the same letters that the girls are. So the teacher says a couple of clips from the [start] of the video `You`re going to tell Thomas it`s a brilliant idea to marry you`. "

"So this school is teaching children about LGBT relationships from the earliest age ... and of course you rapidly learn what`s going on because the teacher says that the children can be more accepting at this age and if you get the information into the children they accept it now . Then you don`t have a problem trying to convince them of what they should accept and believe in later years."

"I looked at the clip several times; it`s utterly fascinating... because what this teacher is doing is indoctrination and she knows it`s indoctrination but she thinks this is acceptable."

"David, I know this is going on with a vengeance north of the border as well."

David Scott: "It certainly is; and we`re seeing it state funded. One of the odd things is this year there has been LGBT `pride marches` all round Scotland. There was one in Perth. There were two at the weekend; one in Inverness and one in the western isles, if you can believe that. And the western isles one, there was a bit of controversy because the western isles counsellors were refusing to fly the `pride flag`. So these are being state funded, well funded, and then what you find is that in each local authority there are agents pushing the agenda. They are often extremely militant LGBT agency activists but they are in state funded organisations, state funded jobs, and very often teaching the teachers or in similar areas of control over the wider education system."


Adverse Childhood Experiences (ACEs)

Mike Robinson: "Right David, we`re going to move on to ACEs and we`ll find out what ACEs are in one second when we look at a short video clip."
 

"So we`ve got a short video here and then we`ve got some stills..."

Mike Robinson: "So David, ACEs and their consequences can be prevented?"

"Yes, so this is the latest thing to come out of America and it`s all over Britain. It`s all over western Europe. This is the new thing. It`s not that new; it`s ten years - no, it`s twenty year old research; but it`s suddenly become the flavour of the month. There`s been a film called `Resilience` which you can`t get to see. It`s been shown to all of the Scottish government employees - made by James Redford - and this is describing what is termed as the `science of hope` if you can believe that; and the `science of hope` goes to show how we`re going to transform society by government action. You have to be hopeful; you have to be optimistic and you have to - well, what do you have to do?"

"And they then go on to show correlations between adverse childhood experiences, and adverse experiences in early life, and negative outcomes, which on average is true; and we`re aware - you know, people in the Fresh Start foundation, particularly so, we`re aware of people who, for example, take to alcoholism in order to self medicate because of childhood abuse. This is true; this happens."

"But there`s something wider happening here because what they`re doing is they`re looking at the statistics of the population as a whole and then they`re taking that and changing it into a decision as to how they`re going to influence the lives of individuals and it becomes government policy and it starts going into some very strange and very totalitarian areas. So that`s what we want to explore here."



"This next slide: this is from the Centre for Disease Control (CDC) in the United States; so this is a government organisation in America. They`re pushing this forward and you see here: `Parent Training today`. So this is one of the areas that is going to be pushed. They`re going to have state appointed parent trainers. So this is going to reduce the independence of parents within family life in the family unit very significantly..."

"So having identified - initially there`s ten ACEs: emotional abuse, emotional neglect, physical abuse etc etc,  although those numbers are growing now. There`s never any limit... The CDC have identified five things they`re going to stop ... happening. So the first one here is `Strengthening economic supports for families`. Now this means strengthening government subsidies for single parents, essentially."


David Scott then puts forward the view: "Economic support means state economic support, wealth transfer and, of course, it`s welfarism that has been the biggest corrosive effect on the family and has caused most of the society wide decay for those who are most vulnerable. "Scott further suggests: "So essentially what we`re doing is we`re going to double down with everything we`ve been doing - we don`t know what else to do - and we`re going to do more of it."

"Next we`re looking at `changing social norms`... So the bedrock of society is the family with traditionally one parent, usually the man providing; and one parent, usually the mother in the more nurturing role. Well, we`re not having that; we`re going to change that; because the state has now stood in the role of the father for providing for the children.  We don`t need fathers quite as much; there are a lot of single mothers and we`re going to make that the norm. We`re not going to think anything ill of that; we`re going to destroy any social propulsion towards a more stable society basis of the family..."



"Then we`ve got `quality child care and education early in life.` Odd diagram that. This is a little girl playing chess with a wheelchair bound old lady. It may be her grandmother; we`re not sure. So that might be an excellent thing to do. We`re not quite sure who`s looking after who there. Then after that, we`ve got `Enhancing parenting skills.` "


"There`s two nice lesbian mothers here, very slim. They`re outside `24-HOUR URGENT CARE parenting class`. `This way.` So we`re going to teach people how to parent. The state`s getting involved in this as well. And then most creepy of all, we`ve got `Intervening to lessen harms and prevent future risk.` So the state - actually it`s not very good at making the trains run on time and repair holes in the road - is going to prevent future risk. It`s going to look into the vibrant dynamic complex world of - you`re a family - and it`s going to decide if you provide a future risk to your children. And if you do ... then they will act to prevent that and there`s no use arguing..."

Named person scheme

"This is where it`s going. It`s very similar to the Named Person scheme It`s very similar to all of the huge lists of `parenting outcomes` and `risk indicators` we have in the Named Person scheme. It`s a slight re-branding of it. It`s based on similar American-based pseudo-science and it`s everywhere."

Mike Robinson: "Sorry David, it strikes me that in some way it`s related to `social credit` which is something that Dr Graham Downing was talking about to Ian Crane on Humanity versus Insanity last night. We`re going to play that programme after this, if you`re watching the UK Column live stream. But, you know, what you`re saying is there`s some kind of measurement made of whether you are a capable parent or not; and if you`re not, the state is going to intervene, potentially up to the point of removing the children."

"... Of course, we know that the state is the worst parent of all. So this is the bizarre thing. The last defence for children is the family unit and this is assaulting the family unit. So it seems superficially plausible but when you actually analyse what it`s doing it`s all acting against children."



"Now the next slide here is: Adverse Childhood Experiences (ACEs). This is from the Scottish government website. The initial ones were from America... It`s been parroted in Scotland. He told the audience of the original study and the accidental realisation that many of them attending who had been to the clinic had been sexually abused in childhood and he says here - there is a core truth to this, right, that you`ve got a lot of abuse; you`ve got a lot of, particularly sexual abuse, but rather than tackling that what we`re doing is we`re using it as an excuse to build the state into an every more powerful vehicle for controlling society. That`s what`s happening here."

"Now the next little bit is just a shocker. This is from the Journal of Applied Philosophy and it is awful, and it is Licensing Parents Revisited. Now this is one of the most disturbing and in many ways ignorant articles I think I`ve ever read. .. He first of all makes the case for licensing professionals and it`s all positive. You know people in the professions may harm those they serve either directly or by failing to fulfil their fiduciary duties and the harm can be significant so we need the state to get in there and regulate. Now we don`t because there are contraindications here but what he ignores is that licensing is very often used by professions to limit access, to ring fence money and to drive up fees. It is not what he`s claiming but he skirts over any real negative effects and then goes on to make the case, well now parenting is ... important, and then we should license parents because we need ... to ensure parents are competent; and then he briefly looks at the fact that we don`t really know how to do that. It`ll be OK."

"And then he looks at the right to have children which he`s not very impressed with. He says ... `she may think she has a right to her children whereas people do not have a right to be professionals` and the conclusion is: `Does a parent have a right to rear the child under her control without interference from the state?` And there`s a false choice here between a parent who might be abusive and one with no state involvement at all; or complete control and the case for independence of family life is broken down and the conclusion is `yes` we have a good case for licensing parenting. This sort of thing which seems crazy I think is on the way in..."

Brian Gerrish: "David, I`ve got to say that as you went through that this is clearly coming in. It`s coming in as policy; that policy coming in through the civil service, but very often we can see that a lot of it originates with the United Nations. But this is very very dark and sinister stuff.  One of the points you`ve just made is that `we allow the abuse of the children to take place` because ultimately this form of control over parents and families can be brought in as an excuse over the top of it."

New rules for girl guides


"The Girl Guides have recently opted to adopt a policy that exhorts the guides to welcome transgender girls. While some critics have expressed concern about young girls sharing rooms and toilets with someone who has the biological attributes and the body of a boy, there is a more fundamental issue at stake."

"As was the case with the Scottish guidelines, the new rules adopted by the Girl Guides indicate that its leaders are not allowed to divulge to parents and the other girls if a member of their group used to identify as a male."

"Whereas the institutionalisation of trans culture and the bypassing of parents in schools has provoked minimal opposition, concern has been raised by parents and leading members of the Girl Guides. This year 224 volunteers and parents wrote an open letter criticising the new policy."

"They rightly pointed out that this policy denied "informed" parental consent. The response of the Girl Guides was to expel two guide leaders and close down their unit. As far as the managers of this organisation are concerned, a parent’s right to know is trumped by its so-called `equality and diversity policy`. "

"Do we really want the Girl Guides or schools to take responsibility for the development of a young person’s sexual identity? "

"Do we really want parents to be blissfully ignorant about the values to which their children are exposed? Apparently many educators believe that they should have the right to guide the gender development of young people."

Fabricated Illness

The website of the NHS describes it as:

"… a rare form of child abuse. It occurs when a parent or carer, usually the child’s biological mother, exaggerates or deliberately causes symptoms of illness in the child."...

"Allegations of fabricated or induced illness (FII) against parents are on the increase from councils trying to avoid paying for special needs services"

"Note here the assertion refers to allegations and not confirmed cases..."
"The claim that local authorities are effectively using a loophole and using internal child protection procedures to avoid complying with statutory obligations is a serious one and no doubt any public servant would be keen to do what they can to ensure that any such fears were allayed. Maybe parents and other interested parties can help. For example, a request to a LA using the rights available in the Freedom of Information Act 2000 to find out the numbers of FII cases in a particular year and also whether the children in question had or were being assessed for an EHCp* may help."

Teenager targeted by extremists

"The authors of a report investigating extremism in Greater Manchester after the bombing at Manchester Arena falsely suggested that anti-fracking activists `groomed` a 14-year-old boy featured in a case study, the Guardian understands."

"The 124-page report by the Greater Manchester preventing hateful extremism and promoting social cohesion commission included the story of a teenager referred to Channel, part of the government’s anti-extremist Prevent programme."

"Calling him Aaron, the report described him as an A* pupil who `was referred to the Channel programme by his school due to concerns about his extreme beliefs in relation to the environment, specifically issues around fracking`..."

"But according to Greater Manchester police, the boy in question was never involved in the anti-fracking movement. He had been targeted by an entirely different group of activists, the force said. The detail was then changed without their knowledge, ostensibly to protect his real identity..."
